Chattii Privacy Policy  

1. Introduction


1.1. This mobile application and the website (collectively, Chattii Platform) are created, operated and controlled by Mass Impact Pty Ltd (ACN 642 451 296) (we, us or our). This Privacy Policy applies to the Chattii Platform and any products or services made available to you on, or via, Chattii Platform. 


1.2. We are committed to ensuring your personal information is protected. We manage your personal information in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act).


1.3. By accessing and using the Chattii Platform you agree to this Privacy Policy. 


1.4. This Privacy Policy outlines how we collect, store, use and disclose your Personal Information, and how you may access your Personal Information and Sensitive Information (as defined in the Privacy Act) kept by us or how you may make a privacy complaint.


2. The information we collect about you


2.1. We will only collect and hold Personal Information and Sensitive Information about you that is reasonably necessary to undertake our business activities and functions, deliver the Chattii Platform and products and services to you, or as otherwise permitted by law. 


2.2. The type of Personal Information that we collect and use depends on the type of dealings that you have with us and includes the following: 

(a) Account and user profile details (for example, full name, nicknames, location, date of birth, mobile phone numbers, email address, profile picture and account credentials, such as username and password);


(b) photographs, images, and drawings of you, whether alone or with others; 


(c) details relating to your age, gender marital status and sexual preferences;


(d) any passwords and account logins created and submitted to the Chattii Platform; 


(e) information relating to personal lifestyle choices or preferences, interests and hobbies; 


(f) information relating to your dealings, or enquiries you have made with us, including information about the products or services you have ordered;


(g) location data such as location information, IP address, GPS or geographical data, tracking information and information about the mobile or device used; 


(h) information regarding your access and use of the Chattii Platform, including information about the mobile device you use, such as location information, IP address and operating system version, device memory, browser type, language, battery level, and time zone; and


(i) other information that you provide to us, or that we may collect, in the course of our relationship with you.


2.3. We may collect Sensitive Information (as defined in the Privacy Act) from you, such as information or opinions about your political affiliations, sexual preferences, religious beliefs, racial or ethnic origin or other such private information. If you do not wish us to collect Sensitive Information, you should not post, publish or share such private information on, or via, Chattii Platform. In this Privacy Policy, a reference to Personal Information shall include Sensitive Information.


3. How we collect Personal Information


3.1. We will collect Personal Information about you in a number of different ways. We may collect Personal Information directly from you or in the course of our dealings with you. For example, when:


(a) you set up or update an account (including contact and profile details) on the Chattii Platform;


(b) you visit, access and use the Chattii Platform or interact or correspond with users of the Chattii Platform (including when you use the chatroom facility made available through Chattii Platform);


(c) you create, post or accept dating or networking opportunities or invitations from other users of the Chattii Platform; 


(d) you contact and correspond with us (for example, when you use the Chattii Platform or seek technicolour IT support from us, report, or wish to make a report about the conduct of another user on the Chattii Platform); 


(e) you access third party websites and social media (including those of our related bodies corporate, business partners, publishers, and service providers);


(f) you provide your Personal Information to third parties (including to our related bodies corporate, business partners and service providers, hosting companies, software development service providers, other users of the Chattii Platform; credit reporting bodies, credit providers, government agencies, public registries, search agencies, regulatory and licensing bodies, parties to whom you refer us (for example, previous employers and referees) and recruitment agencies); 


(g) we receive a complaint regarding your conduct on the Chattii Platform; and 


(h) you are legally authorised or required to provide us with any Personal Information, or otherwise when we request that you do so.


3.2. When we collect Personal Information directly from you, we will take reasonable steps to notify you (using a collection notice) at before, or as soon as practicable after, the time of collection. 


4. How we use your Personal Information 


4.1. We do not sell your Personal Information to any third party. We use and disclose your Personal Information for the purposes for which the information is collected, including (but not limited to):


(a) providing you with access to, or use of, the Chattii Platform (including products or services made available to you on, via, the Chattii Platform);


(b) personalising or customising the content and advertising on the Chattii Platform; 


(c) assisting with, or responding to, your queries;


(d) facilitate the posting, publishing or sharing of content, ideas, data and information by you or other users on, or, via the Chattii Platform; 


(e) informing you about products or services, dating or social networking opportunities, or other matters which we believe are of interest to you;


(f) facilitating conversations through the chat rooms or instant messaging forums which are made available through the Chattii Platform; 


(g) sharing such information with our Third Party Providers;


(h) administering, improving and managing the Chattii Platform;


(i) if you have a Premium Account, charging and billing you for the use of the Chattii Platform; 


(j) verifying your account, identity, and activity on the Chattii Platform; 


(k) direct marketing purposes (see section 6 below); and


(l) complying with our legal and regulatory obligations.


4.2. We use third  party  payment  processors  to  process  payments  made  to  us.  In connection with the processing of such payments, we do not collect, process, use, share, store or disclose any Personal Information or payment information (such as credit card and bank account details). Rather, all such information is provided directly to our  third  party  processor,  Stripe,  whose  use  of  your  Personal Information  is governed  by  their  privacy  policy,  which  may  be  viewed  at https://stripe.com/au/privacy.


5. Disclosure to Third Parties


5.1. In making Chattii Platform available to you, we may disclose your Personal Information to:


(a) sharing such information with our third party providers, which include related bodies corporate, business partners, service providers, third party contractors, agents or suppliers, application, software and product developers, web developers, hosting companies, marketing, advertising and security service providers or other authorised service providers (Third Party Providers) who perform functions on our behalf;


(b) external business advisors, such as our financiers, insurers or professional advisers, including lawyers; and


(c) marketing and research agencies or institutes, (collectively, Third Party Providers). 



5.2. We may also disclose your Personal Information to:


(a) other users of the Chattii Platform whose profile you visited or accessed on, or via, the Chattii Platform;


(b) any other party with your consent and direction; and


(c) law enforcement bodies or regulatory authorities to assist with their functions, or as otherwise required or authorised by law.


5.3. Prior to the disclosure of Personal Information to Third Party Providers, we will take such steps as reasonable in the circumstances to ensure that the Third Party Providers treat your Personal Information or Sensitive Information securely, and otherwise comply, with the relevant Australian Privacy Principles in relation to the Personal Information.


6. Marketing communications


6.1. We may use or disclose your Personal Information when sending you information about the products or services we offer, as well as other information that may be of interest to you. We may send this information in a variety of ways, such as by mail, email, SMS, telephone, social media, notifications via the Chattii Platform or by customising online content and displaying advertising on or via, the Chattii Platform. 


6.2. If you do not wish to receive any of these marketing communications, you can opt out by following the unsubscribe instructions included in the relevant marketing communication, or by contacting us using the contact details set out in section 12 below. 


7. Overseas disclosures of Personal Information


7.1. In the course of providing you with access to the Chattii Platform (including any products or services made available to you on, or via the Chattii Platform), it may become necessary or desirable to disclose Personal Information to Third Party Providers located overseas. The countries in which these overseas recipients may be located will depend upon the individual circumstances. However, in the course of our ordinary business operations we commonly disclose Personal Information to Third Party Providers located in the following countries: Nepal. 

 

7.2. The laws where these overseas recipients may be located provide various levels of protection for Personal Information which are not always equivalent to the level of protection that may be provided for in Australia. Where we transfer your Personal Information overseas we will take reasonable steps to ensure that your Personal Information is treated securely, and that adequate safeguards are provided.


8. Notifiable Data Breaches Scheme‍

In the event of any loss, unauthorised access, or disclosure of your Personal Information that is likely to result in serious harm to you, we will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with notifiable data breach scheme contained in Part IIIC of the Privacy Act.



9. Security of your Personal Information 


9.1. We take steps reasonable in the circumstances to ensure that the Personal Information it holds is protected from misuse, interference, loss, unauthorised access, modification, or disclosure. 


9.2. The transmission of Personal Information through the internet or the Chattii Platform is not completely secure. We cannot guarantee the security of your data transmitted to our online services and any transmission is at your own risk. 


9.3. We will destroy or de-identify Personal Information in circumstances where it is no longer required, unless we are otherwise required or authorised by law, to retain the information.


10. Accessing and correcting your Personal Information


10.1. We take steps reasonable in the circumstances to ensure Personal Information we hold is accurate, up-to-date, complete, relevant and not misleading. Under the Privacy Act, you have a right to access and seek correction of your Personal Information that is collected and held by us.


10.2. If at any time you would like to access or correct the Personal Information we hold about you, or you would like more information about our approach to privacy, please contact us via the contact details set out below. If we refuse your request to access or correct your Personal Information, we will provide you with written reasons for the refusal and details of complaint mechanisms. 


11. Cookies


11.1. We collect cookie information and store data in browser storage on your mobile device when you visit, access or use the our Chattii Platform. A cookie is a piece of data that enables us to track and target your preferences. We may use cookies and browser storage on your mobile device to:


(a) allow you to automatically access and use the Chattii Platform, for security purposes and to personalise and enhance your experience and use of the Chattii Platform; and


(b) help us improve our service to you when you access the Chattii Platform and to ensure that the Chattii I Platform remains easy to use and navigate.


11.2. Cookie information and browser data storage information is used in aggregated form – we do not use it to identify you as an individual. However, if you do not want to accept cookies or you want to delete the data in the browser storage, you can block them by adjusting the settings on your Internet browser. However, if you block them, you will not be able to use all of the features of our websites and this may affect the functionality of the Chattii Platform.

From time to time it may be necessary for us to review and revise our Privacy Policy. We may notify you about changes to this Privacy Policy by posting an updated version on the Chattii Platform.
